By accessing or using AI Contender ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

We may update these Terms at any time. Continued use after changes constitutes acceptance. Material changes will be notified via email or in-app notice.

2. Description of Service

AI Contender is a software-as-a-service (SaaS) platform that provides AI-powered tools to generate on-brand visual content, including banners, graphics, and other marketing materials.

3. Account Registration

• You must be at least 16 years old to create an account.
• You must provide accurate and complete registration information.
• You are responsible for maintaining the security of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

4. Acceptable Use

You agree NOT to use the Service to:

• Violate any applicable laws or regulations
• Infringe on intellectual property rights of others
• Generate illegal, harmful, threatening, abusive, or hateful content
• Create content that is deceptive, misleading, or fraudulent
• Generate content depicting minors in inappropriate contexts
• Impersonate others or misrepresent your affiliation
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service

• Resell or redistribute the Service without authorization

We reserve the right to remove content and suspend accounts that violate these policies.

5. Billing and Payments

5.2 Payment Processing

Payments are processed securely through Stripe. By providing payment information, you authorize us to charge the applicable fees to your payment method.

5.3 Billing Cycle

Subscriptions are billed in advance on a monthly or annual basis, depending on your selected plan. Your subscription will automatically renew unless canceled.

5.4 Credits

Credits are used to generate content. Unused credits may expire according to your plan terms. Credits are non-transferable and non-refundable.

5.5 Refunds

We do not provide refunds for partial subscription periods. If you believe you are entitled to a refund due to service issues, contact us at support@aicontender.pro.

5.6 Price Changes

We may change pricing with 30 days' notice. Price changes apply to the next billing cycle.

6. Intellectual Property

6.1 Our Intellectual Property

The Service, including its original content, features, and functionality, is owned byAI Contender and protected by intellectual property laws. Our trademarks, logos, and brand elements may not be used without prior written consent.

6.2 Your Content

You retain ownership of content you create using the Service ("User Content"). By using the Service, you grant us a limited license to process and store your content as necessary to provide the Service.

6.3 Generated Content

Content generated by our AI tools using your inputs becomes your property upon creation. You are responsible for ensuring your use of generated content complies with applicable laws.

6.4 Feedback

Any feedback or suggestions you provide about the Service may be used by us without obligation to you.

7. Privacy

Your use of the Service is subject to our Privacy Policy, which explains how we collect, use, and protect your data.

8. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• MERCHANTABILITY or FITNESS FOR A PARTICULAR PURPOSE
• ACCURACY, RELIABILITY, or COMPLETENESS of content
• UNINTERRUPTED or ERROR-FREE operation
• SECURITY of data or transmissions

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying all generated content before use.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AI CONTENDER SHALL NOT BE LIABLE FOR:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, use, or goodwill
• Service interruption or system failure
• Content generated by the AI tools
• Any third-party actions or content

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID BY YOU TO US IN THE 12 MONTHS PRECEDING THE CLAIM, OR $100, WHICHEVER IS GREATER.

10. Indemnification

You agree to indemnify and hold harmless AI Contender and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from:

• Your use of the Service
• Your violation of these Terms
• Your violation of any rights of a third party
• Content you create or upload

11. Termination

You may cancel your account at any time through your account settings.

We may suspend or terminate your access immediately, without prior notice, if you violate these Terms or for any other reason at our sole discretion.

Upon termination, your right to use the Service ceases immediately. We may delete your content after a reasonable retention period.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which AI Contender is incorporated, without regard to conflict of law principles.

13. Dispute Resolution

Any disputes arising from these Terms or the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration, except where prohibited by law.

14. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and AI Contender regarding the Service and supersede any prior agreements.
